Shades of Grey in Canada’s Greenwashing Guidelines

Bill C-59 represented the most significant changes to Canada’s Competition Act since it was first introduced in 1986. Among the changes, the deceptive marketing practice of greenwashing has been prohibited. The Competition Bureau recently concluded consultations, but the specifics have raised concerns. The reverse onus approach, lack of guidance on compliance, and threat of large penalties have been called out as key concerns.
